Criminal Record Check

 
As part of your Personal Licence Application, you will need to enclose a CRB check which has been issued no more than a month before sending your application to council. This is to ensure that you have no relevant criminal offences that would disqualify you from holding a Personal Licence.
 
If an applicant for a Personal Licence has unspent relevant offences or foreign offences, the licensing authority can only grant the licence after having consulted the local police. If the police then object on the grounds that, by granting the application, the Crime Reduction objective of the Licensing Act would be undermined, the application must be refused. 

What are relevant offences?

There is a long list of relevant offences in the Act.  They include crimes involving violence and dishonesty, offences under the Licensing Act 1964, offences involving drugs and firearms and drink driving offences. Offences under section 1 of the Trade Descriptions Act 1968
Offences under the the Theft Act 1968
Offences under section 7(2) of the Gaming Act 1968
Offences under the Misuse of Drugs Act 1971
Offences under the Customs and Excise Management Act 1979
Offences under the Tobacco Products Duty Act 1979
Offences under the Forgery and Counterfeiting Act 1981
Offences under the Firearms (Amendment) Act 1988.
Offences under the Copyright, Designs and Patents Act 1988
Causing death by careless driving while under the influence of drink or drugs
Driving a vehicle when under the influence of drink or drugs

A sexual offence
A violent offence. This being an offence which leads to, or is intended to lead to a person’s death or physical injury to a person. An offence which is required to be charged as arson

Do I need a Personal Licence?

If you wish to sell alcohol, under the Licensing Act 2003, you must hold a Personal licence.

If you are to be names as DPS on a Premises Licence, you must hold a valid Personal Licence. 

All sales of alcohol must be authorised by a Personal Licence holder, it is therefore advised that there is more than one Personal Licence holder working at a particular site. 

How much does a Criminal Record check cost?


£25 to complete yourself or £25 if we do it for you. We do not add a fee onto the CRB check as part of your Personal Licence Application.
